These Terms & Conditions (“Terms”) govern the services provided by Avoryx Design, operated by Zoltan Levente Arpasi (“we,” “us,” “our”), a private individual based in Hungary, to clients (“you,” “the Client”) who engage our website design and development services through avoryxdesign.com.

By engaging our services, you agree to these Terms.

1. Who We Are

Avoryx Design is currently operated as an individual service provider, not a registered company. Contracts entered into through avoryxdesign.com are personally between you and Zoltan Levente Arpasi.

2. Services

We provide custom, AI-assisted website design and development for small businesses, including initial builds, publishing, and ongoing support. Websites can be delivered in multiple languages, including English and German, upon request.

3. Project Process

1. Discovery — We gather information about your business and desired website (look, functionality, content).
2. Deposit — Once you agree to proceed, we collect a deposit (50% of the total project price) before beginning work.
3. Build & Preview — We build your website and share a private preview link (not connected to your live domain) for your review.
4. Revisions — You may request up to 2 rounds of revisions on the preview before final approval.
5. Final Payment — Once you approve the preview, we collect the remaining balance.
6. Publishing — Your website is published to your live domain only after full payment has been received.

4. Payment Terms

• All prices are quoted in EUR and payable via a Wise or Revolut payment link.
• The deposit is due before work begins and is non-refundable once the build has started, as it compensates for time and resources committed.
• The final balance is due before your website is published live.
• We do not collect or store your card or banking details directly — all payments are processed through Wise or Revolut.

5. Refunds & Cancellations

• If you cancel before we begin the build, the deposit will be refunded in full.
• If you cancel after the build has started but before publishing, the deposit is non-refundable, but no further payment is owed.
• Once your site is published live, payments are final, except where required by applicable consumer protection law.

6. Ownership

Until full payment is received, all work (designs, code, content) remains the property of Avoryx Design. Full ownership of the final website transfers to you upon receipt of full payment.

7. Ongoing Support (Retainer)

• The first month of hosting and basic maintenance support is included at no cost.
• After the first month, ongoing support is billed at €99/month, covering hosting, uptime monitoring, and minor edits, as agreed at signup.
• You may cancel the retainer at any time; cancellation stops future billing but does not affect work already delivered.
• Larger changes (new pages, redesigns, added features) beyond the scope of basic support are billed separately.

8. Client Responsibilities

You agree to provide timely information, content, and feedback needed to complete your project. Delays in providing this may extend project timelines.

9. Limitation of Liability

We aim to deliver a functioning, professional website, but we do not guarantee specific business outcomes (e.g., traffic, leads, sales) resulting from the website. By accessing, using, or interacting with this website or our services, you agree to comply with all applicable laws and regulations. To the maximum extent permitted by law, our total liability for any claim relating to our services is limited to the amount you paid us for the relevant project, and we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your access to or use of this website or our services. We are not liable for downtime or issues caused by third-party services (hosting providers, domain registrars, payment processors).

10. AI-Generated Content & Acceptable Use

This website and its content are made available for your review and for use in connection with services you engage us for. Unauthorized use, reproduction, or distribution of this website’s content — including copying, scraping, or repurposing it without our permission — may result in legal action, including claims for damages, injunctive relief, and recovery of associated legal costs.

11. Third-Party Services

Your website may rely on third-party services (hosting, domain registration, payment processing). We are not responsible for outages, policy changes, or issues caused by these third parties.

12. Governing Law

These Terms are governed by the laws of Hungary. This applies regardless of your location, though we aim to work reasonably with international clients on any disputes.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
